LICENSE STATEMENT AND LIMITED WARRANTY

IMPORTANT - READ CAREFULLY

This license statement and limited warranty constitutes a legal agreement ("Agreement") between you (either as an individual or a single entity) and Hungarian Academy of Sciences, Chemical Research Center, Institute of Chemistry ("HAS CRC IC") for the Software product ("Software") identified above, including any software, media, and accompanying on-line or printed documentation.

BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE LICENSE AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, WE ARE UNWILLING TO LICENSE THE SOFTWARE TO YOU. YOU SHOULD CLICK ON THE "NO" BUTTON TO DISCONTINUE THE INSTALLATION PROCESS OR CLICK THE "DECLINE" BUTTON TO EXIT THE PROGRAM IMMEDIATELY.

1. LICENSE. HAS CRC IC hereby grants you a nonexclusive license to install and use the Software in machine-readable form on a single computer for use by a single individual. This Software is available for evaluation, but MUST not be used past June 30, 2009. You may copy the Software only for backup purposes, provided that you reproduce all copyright and other proprietary notices that are on the original copy of the Software. This license allows you the right to use results or information gained or conclusions derived by using this Software for scientific and non-profit purposes only. In all cases where information or conclusions are obtained by using this Software and when this is disseminated or published, you have to make a reference to the source of the Software (w3.chemres.hu/ms/glycominer) and to the scientific journal article: Oliver Ozohanics, Judit Krenyacz, Krisztina Ludányi, Ferenc Pollreisz, Károly Vékey, László Drahos; GlycoMiner: A new software tool to elucidate glycopeptide composition, Rapid Communications in Mass Spectrometry, Vol. 22, Page: 3245-3254, 2008

2. RESTRICTIONS. HAS CRC IC retains all right, title, and interest in and to the Software, and any rights not granted to you herein are reserved by HAS CRC IC. You may not reverse engineer, disassemble, decompile, or translate the Software, or otherwise attempt to derive the source code of the Software.. You may not rent, lease, loan, or resell the Software, or any part thereof. You may not sell or disseminate information gained using the Software except as expressly permitted under Section 1.

3. NO WARRANTY. OUR SOFTWARE IS FURNISHED "AS IS". WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, THAT OUR SOFTWARE IS FREE OF ERROR, OR THAT IT WILL MEET YOUR REQUIREMENTS FOR ANY PARTICULAR APPLICATION. WE ACCEPT NO RESPONSIBILITY FOR ANY MATHEMATICAL OR TECHNICAL LIMITATIONS OR ERROR OF MASSKINETICS SOFTWARE. OUR SOFTWARE SHOULD NOT BE RELIED ON SOLVING A PROBLEM WHOSE INCORRECT SOLUTION COULD RESULT IN INJURY TO A PERSON OR LOSS OF PROPERTY OR FINANCIAL DAMAGE.

4. LIMITATION OF LIABILITY. NEITHER MASSKINETICS SOFTWARE, NOR THE AUTHORS SHALL IN ANY EVENT BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT OR INDIRECT, SPECIAL OR GENERAL, CONSEQUENTIAL OR INCIDENTAL, ARISING FROM USE OF OUR SOFTWARE OR OF ANY INFORMATION FOUND IN ITS PRINTED OR ELECTRONIC DOCUMENTATION. USE OF THIS SOFTWARE IS ENTIRELY AT YOUR OWN RISK.

5. TERM AND TERMINATION. This Agreement shall continue until terminated. You may terminate the Agreement at any time by deleting all copies of the Software. This license terminates automatically if you violate any terms of the Agreement. Upon termination you must promptly delete all copies of the Software.

6. CONTRACTING PARTIES. If the Software is installed on computers owned by a corporation or other legal entity, then this Agreement is formed by and between HAS CRC IC and such entity. The individual executing this Agreement represents and warrants to HAS CRC IC that they have the authority to bind such entity to the terms and conditions of this Agreement.

7. INDEMNITY. You agree to defend and indemnify HAS CRC IC against all claims, losses, liabilities, damages, costs and expenses, including attorney's fees, which HAS CRC IC may incur in connection with your breach of this Agreement.

8. GENERAL. The Software is a "commercial item." although this version is free of charge. This Agreement is governed and interpreted in accordance with the laws of the Hungarian Republic without giving effect to its conflict of laws provisions. The United Nations Convention on Contracts for the International Sale of Goods is expressly disclaimed. Any claim arising out of or related to this Agreement must be brought exclusively in the central court located in Budapest, Hungary and you consent to the jurisdiction of this court. If any provision of this Agreement shall be invalid, the validity of the remaining provisions of this Agreement shall not be affected. This Agreement is the entire and exclusive agreement between HAS CRC IC and you with respect to the Software and supersedes all prior agreements (whether written or oral) and other communications between HAS CRC IC and you with respect to the Software.
